1. Terms

By accessing this Site, you are agreeing to be bound by these Terms of Use, which are entered into between You (the “User”) and Thaneeya LLC (”Online School”, “Site”, “Course”). You are bound by all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this Site.

2. Copyright

The Course Materials contained in this Online School are original, copyrighted intellectual property that is owned by Thaneeya LLC. “Course Materials” include, but are not limited to: text, video, audio, images, and PDF documents.

All Online School materials are protected by applicable copyright and trademark law. All rights, title and interest in any Intellectual Property is and shall remain the exclusive property of Thaneeya LLC. Thaneeya LLC does not waive any moral rights, including the right to the integrity of any copyrighted works and the right to be associated with any copyrighted work as its author by name or under a pseudonym.

Any artwork produced by the User as a result of following Thaneeya LLC’s video tutorials, or based on line art provided as Course Materials, are legally considered to be “Derivative Works” and as such, the copyright remains with Thaneeya LLC.

3. Use License

Course Materials are offered for the personal, non-commercial, educational use of the individual User only.

  1. Permission is granted to temporarily download one copy of any downloadable Course Materials on the Online School’s website onto the User’s personal computing device for personal, non-commercial, educational use only. This is the grant of a license, not a transfer of title, and under this license you may not:
  2. modify or copy the Course Materials;
  3. share, distribute, repackage, repurpose or reteach the Course Materials in any form;
  4. use the Course Materials for any commercial purpose;
  5. sell any artwork that you created that uses the Course line art as a basis;
  6. use the Course Materials for any public display or broadcasting (commercial or non-commercial);
  7. attempt to decompile or reverse engineer any software contained on the Online School’s web site;
  8. remove any copyright or other proprietary notations from the Course Materials; or
  9. transfer the Course Materials to another person or 'mirror' the Course Materials on any other server.
  10. Permission is granted for the User to:
  11. print any PDF documents that are included in the Course (for personal, individual, non-commercial use only);
  12. use physical art media to color in the line art, blending charts, color charts, or any other PDFs that are included in the Course, for the personal, non-commercial, educational use of the User only;
  13. post your completed Course artwork online, as long as your post includes proper credit to Thaneeya McArdle.

For example: “This artwork is based on a lesson from Thaneeya McArdle’s Ultimate Guide to Using Alcohol Markers.”

Posting completed Course artwork online without the inclusion of proper credit constitutes copyright infringement.

This license shall automatically terminate without warning and without refund if you violate any of these restrictions. Upon terminating your viewing of these Course Materials or upon the termination of this license, your login credentials will be disabled and you must destroy any downloaded Course Materials in your possession whether in electronic or printed format. Thaneeya LLC reserves the right to terminate access to free Course Materials at any time.

You acknowledge and agree that in the event that you breach any of these intellectual property provisions, Thaneeya LLC reserves the right to pursue any monetary, performance, injunctive and other equitable relief against you as a remedy for any such breach. You agree that you will not oppose the granting of such relief, and that you will pay any costs, fees, charges and expenses, including legal fees, that may be incurred by Thaneeya LLC in the process of enforcing these provisions relating to our Intellectual Property.

4. Disclaimer

The materials on the Online School’s website are provided 'as is'. The Online School makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, the Online School does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Site or otherwise relating to such materials or on any sites linked to this Site. You acknowledge and accept that Thaneeya LLC does not provide any guarantees as to any future outcomes of any kind related to your use of this Online School. You agree that Thaneeya LLC is in no way liable for any type of damages or adverse consequences that may arise from your application, use or interpretation of the Course Materials, and you release Thaneeya LLC from any and all such claims.

Some links within this Online School may lead to other websites, including those operated and maintained by third parties. Thaneeya LLC includes these links solely as a convenience to the User, and the presence of such a link does not imply a responsibility for the linked site, nor a guarantee of the linked site’s accuracy, availability, content or policies. The User accepts sole responsibility for and assumes all risk arising from the User’s use of any such websites and products.

The User acknowledges that Thaneeya LLC may receive affiliate commissions and other payments from third parties if you purchase from such websites. These affiliate relationships will be conspicuously disclosed in clear language close to any such links.

In no event shall the Online School be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the Online School’s website, even if the Online School or an authorized of the Online School has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

The materials appearing on the Online School’s website may include technical, typographical, or photographic errors. Any claim relating to the School’s Site shall be governed by the laws of Thaneeya LLC’s home jurisdiction without regard to its conflict of law provisions.
